These Terms and Conditions govern all services provided by OhBe (trading name of Obi Spencer, sole trader) to clients. By booking any service with OhBe, you agree to these terms in full. Please read them carefully before proceeding.
OhBe is a London-based creative business offering photography, videography, brand identity, and digital identity services. OhBe is operated as a sole trader by Obi Spencer.

OhBe offers the following core services:
Package names, deliverables, and fees are confirmed in your quote or written agreement. OhBe is not VAT registered unless stated otherwise on an invoice.
All services are subject to availability. OhBe reserves the right to decline any project enquiry at its discretion.
No booking is confirmed until a deposit has been received. A production date or project slot will not be held for any client without a paid deposit.
A non-refundable deposit of 25% of the agreed project fee is required to secure your booking. The remaining balance is due prior to, or on, the date of delivery unless otherwise agreed in writing.
By paying the deposit, the client confirms they have read and agreed to these Terms and Conditions in full.
If a client wishes to cancel a confirmed booking, they must notify OhBe via email to hello@ohbe.co.uk with a minimum of 48 hours notice before the scheduled shoot or project start date.
The deposit is non-refundable under all circumstances. If the client cancels for any reason, including cancellations made with more than 48 hours notice, the deposit will not be returned.
If a client cancels with less than 48 hours notice, the full deposit is forfeited and OhBe reserves the right to invoice for any pre-production costs already incurred.
Clients wishing to reschedule a confirmed booking must notify OhBe with a minimum of 24 hours advance notice before the original scheduled date.
Rescheduling requests made with less than 24 hours notice will be treated as a cancellation under Section 4. The deposit will be forfeited and a new deposit will be required to secure a new date.
In the unlikely event OhBe needs to reschedule, the client will be notified as soon as possible and a new mutually agreed date will be arranged at no additional cost.
OhBe's standard turnaround for photography and videography deliverables is 72 hours from the date of the shoot or completion of post-production, unless otherwise agreed in writing.
Final assets are delivered digitally - typically via the OhBe client portal, a secure download link, or another method agreed in writing. Invoices may also be issued through the client portal when enabled for your account.
OhBe will always endeavour to meet agreed delivery timelines. In the event of an unavoidable delay, the client will be notified promptly. OhBe is not liable for delays caused by factors outside its reasonable control.
The number of revision rounds included depends on the service tier selected:

Revisions requested beyond the included rounds will be quoted and charged separately. OhBe will confirm the cost in writing before proceeding.
A revision round is one consolidated set of amends provided by the client in a single communication. Multiple separate requests submitted individually may each count as a separate revision round.
Upon receipt of full payment, OhBe grants the client a non-exclusive, perpetual licence to use all delivered assets for:
This licence is for business use only and is limited to digital and social media contexts unless an asset licence has been separately purchased.
The following uses are not included in the standard content licence and require a separately purchased asset licence:

Billboard and large-format use requires both an asset licence and, in most cases, upscaling of the original files. Additional fees apply for both. OhBe will provide a quote upon request.
OhBe retains the right to use all delivered work in its own portfolio, website, social media channels, and promotional materials, unless the client requests otherwise in writing prior to the shoot. Confidential or commercially sensitive work will be handled with discretion.
Where music is included in video deliverables, OhBe licences tracks exclusively through royalty-free music platforms (including but not limited to Artlist, Musicbed, or Epidemic Sound). These licences cover commercial use in digital and social media contexts. Sync licences for broadcast, film, or major commercial placements are not included and must be arranged separately.
OhBe is based in London. All production within London is covered within the agreed project fee.
OhBe is available for projects outside London. All travel costs incurred for work outside London, including transport, accommodation where applicable, and subsistence, are to be covered by the client. Travel costs will be agreed in writing before any booking is confirmed.
The client agrees to:
OhBe is not liable for delays or quality issues arising from a client's failure to fulfil these responsibilities.
25% non-refundable deposit due at the time of booking to secure the date.
The remaining 75% of the agreed project fee is due prior to or on the date of final delivery, unless otherwise agreed in writing.
OhBe reserves the right to withhold delivery of final assets until full payment has been received. Persistent late payment may result in cancellation of the booking.
Digital Identity and other monthly retainers are billed monthly in advance unless otherwise agreed in writing. Retainers have a 3-month initial term. After the initial term, the retainer continues on a rolling basis and either party may end it with 28 days' written notice.
OhBe may provide access to a password-protected client portal for deliverables, invoices, and project files. Access is personal to your organisation; you must keep login details confidential and notify OhBe if you suspect unauthorised access. Files in the portal remain subject to these Terms until full payment is received.
OhBe's total liability to the client for any claim arising out of or in connection with the services shall not exceed the total amount paid by the client for the specific project in question.
OhBe is not liable for:
All original work created by OhBe during a project remains the intellectual property of OhBe until full payment has been received. Upon receipt of full payment, the licence described in Section 8 is granted to the client.
OhBe retains all moral rights in the work as the creator, in accordance with the Copyright, Designs and Patents Act 1988.
OhBe treats all client information and project details as confidential and will not disclose them to third parties without the client's consent, except where required by law.
OhBe may offer an optional mailing list for news, portfolio updates, production insights, and promotional offers. Joining the list is entirely voluntary and requires your explicit consent at signup (including confirmation via the website signup form).
Marketing emails are separate from project-related correspondence (quotes, bookings, deliverables, invoices). Content and frequency may vary; we aim to send only relevant updates and not to overwhelm subscribers.
You may unsubscribe at any time using the link in any marketing email or by contacting hello@ohbe.co.uk. OhBe will stop sending marketing emails once your request has been processed. How we handle your data is explained in our Privacy Policy.
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
OhBe reserves the right to update these Terms and Conditions at any time. The version published on the OhBe website at the time of booking applies to that booking.
